Terms of Reference for EPIC Job Portal Advertisements

These terms of reference (“Terms”) govern the EPIC job portal, hereafter referred to as “Site” and all Advertisers (defined as “Advertiser”, “you” and ” your”) that:

  • have placed a job advertisement (the relevant ad) on the EPIC Job Portal;
  • have utilised any features of the Site or Products offered through the Site.

Your access to and use of the information, materials and services provided on this Site is conditional upon your acceptance and compliance with the Terms.

EPIC Job Portal

The EPIC Job Portal is being set up as part of an initiative to create greater engagement with the EPIC community. The EPIC Job Portal will contain a separate job page where EPIC tenants are able to post their current vacancies.

Way of working

Each EPIC tenant will be issued with an account to manage their own advertisements through the portal. When publishing advertisements, they are immediately placed on the website and will be ordered by date of publication and can be organised by job category and contract. Standard job advertisements are valid for 100 days and are free of charge.

EPIC reserves the right at all times without the need to have to provide any notice to you, to alter the functionality and/or appearance of its products and services available from EPIC or the Site itself, including but not limited to advertisements on the Site and/or as they are represented on mobile communication devices.

Your responsibilities

You must ensure that all job advertisements posted to the Site comply with all applicable legislation, regulations, by-laws, ordinances and codes of conduct, including but not limited to the:

  1. Fair Trading Act 1986
  2. Privacy Act 1993 including the Information Privacy Principles;
  3. Real Estate Agents Act 2008; and
  4. Human Rights Act 1993

You are not permitted to promote or refer to brands other than those associated with your business, (or a business operated by a related party to you):

  1. within the details of a job ad
  2. from within the job application process;
  3. within or from a previously approved externally hosted application form; or
  4. within an employer/company profile; or
  5. within any communications with a candidate via the website

EPIC reserves the right at all times without the need to have to provide any notice to you, to alter the functionality and/or appearance of its products and services available from EPIC or the Site itself, including but not limited to job advertisements on the Site and/or as they are represented on mobile communication devices.

Privacy

Any ‘personal information’ (within the meaning of the Privacy Act 1993) of any candidate that you obtain through your use of the Site or any features of the Site or products offered on the Site (including job applications received from candidates) must only be used by you in relation to your genuine employment and/or recruitment activities.

You may not under any circumstances provide any candidate personal information you have obtained through your use of the Site (including job applications received from candidates) to any other party, including to any affiliate or related party of yours. This restriction on forwarding personal information applies irrespective of whether you receive direct financial benefit for doing so.

Intellectual Property

EPIC retains all intellectual property rights subsisting in any of the goods and services provided to you by EPIC.
